Proposed Changes to Hauraki District Council [HDC] District Plan (updated August 2010) You may be aware that HDC is about to advertise a change to their District Plan Rules governing rural subdivision by increasing the minimum area for a rural lot to 40ha rather than 6ha for Class I - III land. This proposed change will become fully operational whenever the consultative process is completed. HDC plan to publicly notify this Proposed Change to the District Plan on 24 August 2010 ready for submissions from the public and ratepayers. See HDC Proposed District Plan Review. As soon as Council advertises this change all applications for rural subdivision consent will need to take into account this new minimum area requirement as well. This will effectively increase the minimum area for all future rural subdivision lots. It could even prevent further subdivision of some properties. We understand other Councils in the greater Waikato area are also considering raising their own subdivision rules governing the minimum area requirements for rural subdivision to the same minimum lot size. In the Matamata Piako District Council District Plan the minimum rural lot size is currently 8ha. If Council does decide to increase the minimum rural lot size they will also need to advertise the proposed change in a manner similar to that being undertaken by Hauraki District Council as described above. However, any subdivision resource consent granted by any Council under its current rules will remain valid for a period of 5 years from the date of resource consent. If you are able to obtain a resource consent to subdivide your property under the current rules that consent cannot be changed by any subsequent changes to the District Plan in the next 5 years.You will be able to carry out your subdivison in an orderly manner provided you have a current resource consent in place. If you are considering a rural subdivision in the near future it would be in your best interests to act promptly to avoid the likelihood that the proposed, and any possible, changes to any Council's District Plan rules do not prevent you from carrying out your wishes.
